Garage Sale Market Privacy Policy

Garage Sale Market is currently offered free of charge. We do not take payments or process any payment-card or financial information, and paid features are not offered at this time. Sections of this Policy that describe payment or advertising data do not currently apply. This document is provided in English and Spanish; for users resident in Spain, the Spanish version prevails.
Garage Sale Market (“GSM,” “we,” “us,” or “our”), a business name of ProgTrack, LLC, respects your privacy. This Privacy Policy explains how we collect, use, share, and protect your information when you use our website and related services (collectively, the “Service”).
1. Information We Collect
- Account Information: Name (optional), email address, and optional physical address for sale listings.
- User Content: Images, descriptions, and other materials you upload to promote your sale.
- Payment Data: Garage Sale Market is free and does not collect, process, or store any payment-card or financial information.
- Technical Data: IP address (stored hashed/truncated), device information, browser type, and basic usage data used for security, troubleshooting, and aggregate analytics.
2. How We Use Information
- To create, display, and manage your online sale listing;
- To communicate with you about your account, listings, and support requests;
- To maintain and improve the performance, reliability, and security of the Service; and
- To comply with legal obligations and enforce our Terms of Service.
3. How We Share Information
We do not sell or rent your personal information.
- We may share information with service providers such as hosting companies and email providers who help us operate the Service, under confidentiality and data-processing obligations.
- We may disclose information when required by law, valid legal process, or to protect our rights, property, or safety, or that of users and the public.
4. Business Transfers
If GSM is involved in a merger, acquisition, sale of assets, corporate restructuring, or similar transaction, your personal information may be transferred as part of that transaction. Any acquiring entity will be required to honor this Privacy Policy or adopt a successor policy that offers equal or greater protection.
5. Display of Email, Phone, and Address
Your email address may be publicly visible so potential buyers can contact you. If you choose, you may also display your phone number as an additional contact method. Your physical address will only be displayed if you explicitly choose to show it in your listing settings, and you represent that you have the legal right to use and publish that address, as described in our Terms of Service. You can hide your phone number, or all or part of your address, at any time.
6. Data Retention
We retain your account information for as long as needed to operate the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Technical/analytics data is retained for no longer than 14 months and then deleted or anonymized. Sale listings and related data may remain in backups or logs for a limited period after they expire or are removed. You can request deletion at any time (see Sections 11 and 15).
7. Children’s Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has used the Service or provided information without proper consent, please contact us at legal@garagesalemarket.com, and we will promptly delete the information.
Individuals aged 13–17 (in the United States) may use the Service only through an account held and supervised by a parent or legal guardian, as described in our Terms of Service. For Spain, the digital-consent age is 14 (see Section 15).
8. Cookies and Analytics
We use a strictly-necessary session cookie to support essential site functions (such as keeping you logged in) and to gather limited aggregate analytics about how the Service is used. For details and your choices, see our Cookie & Consent Notice.
9. Security
We use reasonable administrative, technical, and physical safeguards (including hashed passwords, encrypted transport, and access controls) designed to protect your information. However, no online service is completely secure, and we cannot guarantee absolute security of your data.
10. Where Your Data Is Stored
Your data is stored and processed within the European Union, on servers located in Germany. ProgTrack, LLC administers the Service from the United States; any access from outside the European Economic Area (EEA) is limited to what is necessary to operate, secure, and support the Service. If you are located in the United States, your data is processed on these EU-based servers in the same way.
11. Your Choices
- You may update certain account information by logging into your account.
- To access, correct, export, or delete your information, or to close your account, email legal@garagesalemarket.com (or support@garagesalemarket.com); we handle these requests manually.
- You may unsubscribe from promotional emails using the “unsubscribe” links included in those messages.
12. External Links
The Service may contain links to external websites or services that are not operated by GSM. This Privacy Policy does not apply to those third-party sites, and we are not responsible for their content or privacy practices.
13. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Effective Date” and Version at the top of the Policy, and for material changes we will ask you to re-accept before continued use.

15. Additional Information for Users in the EEA / Spain (GDPR)
(a) Data Controller & EU Representative
The controller of your personal data is ProgTrack, LLC, a limited liability company organized in Texas (USA), operating “Garage Sale Market.” We have designated, in writing, an EU Representative (GDPR Art. 27) as a point of contact for data subjects and supervisory authorities, reachable at legal@garagesalemarket.com; we provide the representative's identity and contact details on request to any data subject or supervisory authority. Designating a representative does not constitute an establishment in the EU (Recital 80 GDPR). We have not appointed a Data Protection Officer, as our processing does not meet the Art. 37 thresholds.

We collect no payment data in the EU (the service is free) and carry out no profiling or automated decision-making producing legal or similarly significant effects.
(c) International Transfers
Your data is stored and processed within the EEA (Germany) and is not transferred outside the EEA to operate the Service, so no Chapter V transfer mechanism is required.
(d) Your Rights
You have the right to access, rectify, erase (“right to be forgotten”), restrict or object to processing based on legitimate interests, data portability, and to withdraw consent at any time where processing is based on it. You also have the right to lodge a complaint with the Spanish Data Protection Authority (AEPD) — www.aepd.es — or your local supervisory authority.
